Liens on Property

A question that sometimes arises during the sale of a property is "does this property have any liens on it?". A great question, since when you make a purchase you don't want to take on anyone else's old problems.

However this problem can be quickly answered by checking the records at the courthouse, which is usually done by the Title Insurance Company prior to closing.  In Wisconsin, once you have a signed and accepted Offer to Purchase, your Real Estate Agent or bank will order the closing paperwork which will include Title Insurance. The Title Insurance Company will review the property records and report back on any liens or encumbrances it finds.  Then it's the Seller's job to take care of these issues before the closing date.
